REMINDER – HOLIDAY PAY FOR ARAW NG KAGITINGAN (April 9, Friday):

REGULAR HOLIDAY PAY RULES:

• If the employee DID NOT work, he/she shall be paid 100 percent of his/her salary for that day
• If the employee WORKS during the regular holiday, the employee shall paid 200 percent of his/her regular salary for that day for the first eight hours.

THE CONDITION SO THAT AN EMPLOYEE WILL BE ENTITLED TO HOLIDAY PAY:

  • Is the Employee present on the workday immediately preceding (BEFORE) the holiday; or should be on leave of absence with pay on the day immediately preceding (BEFORE) the holiday.

So yes, dapat April 8 (Thursday) pumasok —- or on rest day (If so, dapat April 7 pumasok) or on leave that’s properly filed AND approved by company —- para mabayaran ang April 9.

Note: DOLE Labor Advisory No. 4, Series of 2021 EXEMPTS companies that totally closed during the community quarantine to be exempted from paying holiday pay. Meaning, ZERO obligation to pay holiday pay as above pag sarado ang company dahil sa government lockdown.

    1. Ask your HR how to apply for paid leave. All companies have different practices. Good luck!

    Pls Advise what if employee did not report on holiday (scheduled employee operation staff) and filed a leave w/pay instead… is it ok if we deduct his leave to his leave credits even if it is a regular holiday and yes he is entitled to 100% since it is leave w/pay… what if May 13 is LEAVE W/O PAY? is he still entitled to 100%? by the way he is monthly rate with 313 factor.

    1. Yes deduct his leave since he filed a leave.

      If May 13 was a leave without pay, he is only entitled to 100%.

      This however only works for daily paid. For monthly paid, this is already incorporated to his monthly pay.

    Please advise employee is present during the holiday but absent (without leave) a day prior the holiday? Entitled pa din po ba c employee para sa 200% legal holiday premium?
